Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Flyback platform operated by Flyback Technologies Private Limited ("Flyback", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use Flyback. By using our services, you represent that you are of legal age and have the capacity to enter into a binding agreement. Our services are currently available to professionals seeking employment opportunities in India.

2. Account and Access

Flyback operates on an invitation and approval basis. Submitting an application does not guarantee access to the platform. We reserve the right to accept or decline applications at our sole discretion without providing a reason.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to provide accurate, current, and complete information during the application process.

3. How Flyback Works

• Application: You submit your WhatsApp number and resume for review.
• Conversation: If approved, you engage in AI-assisted conversations that build a comprehensive professional profile.
• Matching: We create anonymized candidate briefs and introduce you to decision-makers in our hiring network who are looking for profiles like yours.

Flyback acts as an introduction service. We are not an employment agency, recruiter, or staffing firm. We do not guarantee employment, interviews, or any specific outcomes. Any hiring decisions are made solely between you and the hiring organization.

4. Your Content

You retain ownership of the content you provide to Flyback, including your resume, conversation responses, and any other materials ("Your Content"). By submitting Your Content, you grant Flyback a non-exclusive, worldwide, royalty-free licence to use, process, store, and display Your Content solely for the purpose of operating and improving our services.

You represent that:

• Your Content is accurate and truthful
• You have the right to share Your Content with us
• Your Content does not infringe any third party's intellectual property or other rights
• Your Content does not contain false, misleading, or fraudulent information

5. AI-Assisted Services

Flyback uses artificial intelligence to facilitate conversations, analyse your professional background, and generate candidate profiles. While we strive for accuracy, AI-generated outputs may contain errors or misinterpretations. You will have the opportunity to review and correct information in your profile.

Our AI distinguishes between claims you make directly and inferences drawn from conversation. Both categories are clearly labelled in your profile.

6. Anonymized Briefs

Candidate briefs shared with hiring partners are anonymized by default. Your name, contact information, and other directly identifying details are not disclosed to hiring partners without your explicit consent. If a mutual interest is established, we will seek your permission before facilitating a direct introduction.

7. Prohibited Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Impersonate another person or misrepresent your qualifications
• Use the platform for any purpose other than legitimate career exploration
• Attempt to reverse-engineer, scrape, or extract data from our platform
• Interfere with or disrupt the operation of our services
• Share access credentials with third parties
• Use automated tools or bots to interact with the platform

8. Intellectual Property

The Flyback platform, including its design, AI models, matching algorithms, branding, and all associated intellectual property, is owned by Flyback Technologies Private Limited. You may not copy, modify, distribute, or create derivative works from any part of our platform without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Flyback shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of employment opportunities
• Decisions made by hiring partners
• Inaccuracies in AI-generated content
• Unauthorized access to your account
• Service interruptions or technical failures

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you have paid to Flyback in the twelve months preceding the claim, or INR 10,000, whichever is greater.

10. Termination

You may request deletion of your account and data at any time by contacting us. We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

11. Modifications

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date and, where practicable, by notifying you via WhatsApp. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
